Advice for Employees in the Snow

While it may seem like more fun to play in the snow, than scrape it off your car in a morning, Nottinghamshire employees are being warned of the consequences for failing to turn up for work.

Tony Russell, Head of Employment at Fraser Brown, said, “Generally, employees are only entitled to be paid for work they have done. Therefore, if an employee is unable to come into work because of the snow, there is no general right for them to be paid, even if the poor weather conditions prevent them from travelling. Employers may choose to exercise their discretion and pay employees. This will usually depend upon the attempts an employee has made to come into work.

"Failure to attend work is potentially a disciplinary offence, but it is unlikely that an employer would take formal action given the widely documented difficulties facing many across the country. Employers will also need to be mindful of the duty of care owed to an employee regarding their health and safety. If an employer insists that an employee comes to work, and an employee has an accident on their way, the employer may potentially be liable."
