High percentage of commercial court cases involve foreign litigants

Don Peel

Figures recently published by the Justice Minister show that, since records started in 2008, there has been a year on year increase in the number of cases in the Commercial Court involving at least one party from abroad.

In 2012 – 2013, 1,190 claims were issued in the court, of which 81% involved a foreign litigant. Only 58 cases were heard in 2013.

The fee income generated by the courts during the 2012 – 2013 period was approximately £2.3 million, which was more than double the fee generated in 2007 – 2008.

The Ministry of Justice has recently launched a consultation on plans to increase court fees, which has been met with several negative responses. The consultation response is due shortly.
