Civil Partnerships and same sex marriage

Civil partnerships give gay and lesbian couples the same legal rights and responsibilities as married couples in relation to property, inheritance, social security and pension benefits.

Civil partners can enter into an agreement equivalent to a Prenuptial Agreement which has the same legal effect.

If a civil partnership breaks down, the process for dissolving the partnership almost identical to divorce with the same facts applicable on which the dissolution must be based, with the exception of adultery, which does not apply in civil partnership cases.

Just like divorce, the dissolution of the civil partnership ends the relationship and leaves both partners free to enter into another civil partnership or marriage.

The financial rights of civil partners on dissolution are equivalent to those of a divorcing couple and the procedure for resolving financial issues is the same in all significant respects.

We can provide specialist advice on civil partnerships and the developing case law relating to finances on the dissolution of a civil partnership.
