Fraser Brown offer advice about A46 roadwork compensation

Part of the A46 widening project has now been completed, with the opening late last year of a dual carriageway between Cropwell Butler and Car Colston. The project is due to be fully completed by this summer.

Under Part I of the Land Compensation Act 1973, compensation can be claimed by people who own and occupy property that has reduced in value by more than £50 by physical factors caused by the use of the altered road.

 

Part I compensation aims to compensate the owner of a property for the depreciation in the market value caused by the physical factors of noise, vibration, smell, fumes, smoke, artificial lighting, and the discharge onto the land in respect of which the claim is made of any solid or liquid substance.

 

Another way in which to claim compensation is for blight. Blight is where the relevant authority (in this case the Highways Authority) purchases a property which the owner has made reasonable endeavours to sell, but has not been able to do so except at a price substantially lower than that which they might have sold it for prior to the road improvements.

 

In the case of the A46 improvements, both sorts of claim will be made to the Highways Agency. They will then employ a district valuer to assess the relevant compensation. Based on that assessment, the Highways Agency will then either make an offer or not.
